Wrong. Performance rights are usually administered and
handled by places like BMI and ASCAP (especially in
the case of 'record labels'). So, if that club isn't
paying their BMI or ASCAP dues, they can and will be
hounded by BMI and ASCAP for artists who they hold
performance rights for performing their own songs in
those same clubs. Happened here in SF a few times now.
Unfortunatley BMI and ASCAP are taking cues from the
RIAA about heavy handed tactics and are going after
some of the smallest venues in the past few years.
