Exactly. This is a continuing problem in intellectual property right
now. I'm working on a paper for my law review (I'm a law student) on
open source, but this is exactly the same problem. You have a third
party, with an agenda, enforcing a copyright dispute. The way the rules
normally function, if the artist/copyright holder doesn't care then they
don't sue. This is fine for most situations. Because independant dance
music producers don't tend to have lawyers they never even thought about
it and even if they did they'd be horrified to find their lawyers suing
their customers for the intended use of the product! This could be
solved with a DJ license, a few words printed on the record jacket that
entitle DJs to play the record on mixes or in clubs. So, who's rights
are we protecting by litigating this? The artists want DJs to play
music all over, the DJs want to be able to play them without getting
sued. Both parties are happy! A third party like the RIAA has no
legitimate interest in the situation, they don't own the damn
copyright! Just like open source, the programmers are happy with the
way their code is being licensed, so who says they can't do it this
way! A legalize version of this should be available to the microsound
community if they care to read it...
