I don't know of any recorded artist that did not have to give up at
least some rights to his/her own work (be it music copyright,
mechanical reproduction, publishing etc) to the record company that
signed that poor soul (yes, even some independent companies demand
that. Not all. Some). If the record company in question is RIAA
member, then RIAA has all the interest and all the right to defend the
above mentioned member.

<quote source="http://www.riaa.com/about/default.asp";>
The Recording Industry Association of America (RIAA) is the trade
group that represents the U.S. recording industry. Its mission is to
foster a business and legal climate that supports and promotes our
members' creative and financial vitality. Its members are the record
companies that comprise the most vibrant national music industry in
the world. RIAA members create, manufacture and/or distribute
approximately 90% of all legitimate sound recordings produced and sold
in the United States.

Libre license is the answer but, as the things are right now, not for many.
