I think if it was a commercial release that it violates the Fair Use
provision of US Copyright law even if it never made any money.
To be technical, it violates US Copyright Law period. Fair Use is an
extremely limited exception where you are allowed to use parts of a work
for educational purposes or parody. The courts have not extended it
much past this. Sampling is still a big legal nono without permission.
But then again, just try and stop us... (whether you support that or
not, it's the prevailing additude.)
Also in refrence to the club promotion/DJ idea...
Dance music producers often print very small runs of their records which
are often deliberately sold with the knowledge and intent that they be
used live, credit or not!
DJs (who buy a lot of music) would be unlikely to purchase underground
dance records at all if they thought they were going to be prosecuted.
The money is a little different, a lot of underground techno albums are
only purchased by DJs and only make it to the home listener through mix
tapes or in clubs.
This is why I proposed a DJ license, this way producers could give
permission to play the record in public in advance with the purchase of
the record itself.
Producers who refused to give DJs permission to play records would
likely see album sales drop (especially if it was enforced). You can
also work the cost into the record price itself.
As for superstar (and superrich) DJs, they best get off their asses and
support their scene, because if they don't they'll run out of records to
play and very few of them are talented enough to write their own
material. Of course trainspotters can expose what a DJ is playing
anyway... People figure it out.
As for greedy club promoters, well, the best rave I went to was a
non-profit collective run situation. Vote with your dollars! Let
people know who rips people off and then don't support those that do.
As long as we're in a 'one dollar one vote' capitalist system, carefully
choosing who you give your money to is still your best weapon against
creeps!
