[microsound] sampling ruling and call for works
ok, so are all of us sample nerds well aware (yes) of the recent US
court ruling of funkadelic vs nwa? basically nwa took a three-note
sample from a funkadelic song and used it as a textural element in
their song "100 miles and running". i'm not sure why this case suddenly
came up, but it did, and it reversed a previous ruling that said it was
ok since "no juror, even one familiar with the works of george clinton"
could recognize the sample. so basically this could translate to "i
don't care how DSPed this amen break is, you're paying for it".
aaaaaaanyway, downhill battle (a group that promotes filesharing as
civil disobediance against a corrupt record industry, amongst other
things) has announced as a protest a project called "three notes and
runnin" which asks sample musicians to make 30 second songs solely
based on the original 3 second clip and submit them to the site for
download. more information on the project is at
http://www.downhillbattle.org/3notes/ .
rock and roll

sample and hold
