[microsound] mix cd's pt 2



also, let me clarify something:
    - the mix CD Silent produced was a layering of various current ambient
tracks by the DJ -- and none of the pieces were used in their entirety...it
wasn't a CD comprised of playing one track, fading it out and fading in the
next...this CD very different and constituted a 'new work' which was made up
of many other works...we not only felt that it helped to promote a emerging
genre but it also promoted artists who weren't even on our label...ambient
DJ's would often create new work by layering and mixing long tracks of
ambient content often resulting in work that was almost unrecognizable via
being recontextualized...in this way I think you could view the use of the
tracks on this CD as 'fair usage' because none of them were presented in
whole and the CD was used to promote an emergent style of DJ'ing and
electronic music...

the (over)reaction by the Mr. blotters' pit-bull was simply an act of
someone being 'pumped' due to becoming 'famous' and an dance music industry
'playa'...this is exactly the sort of attitude which stifles the 'incentive
to innovate' -- to borrow a term from Lessig's book...which I highly
recommend reading...

a more reasonable reaction might have been to call me and ask me for 'n'
number of copies so they could cross-promote the CD at their shows...build a
buzz via meme spreading...

protecting your IP is good (FYI: Silent vigorously protected their
trademark/logo -- we had to by law) but working as a community (i.e.,
sharing) can open up new ways of doing business/co-evolving through
cooperation...rather they made enemies of us and alienated a potential
promotional ally...
